How To Win Against Moving Scam Using BBB Arbitration
People are ripped off everyday by moving companies; but only a few fight back. Here’s the story of a couple that was cheated by their movers, and wouldn’t quit until they got compensated. The couple got a quote from a moving company. But after the truck was loaded and reweighed, the family was told the items weighed 7,000 pounds more than originally anticipated. The couple didn’t want to pay the increased price; unfortunately, they had no choice; they had sold their house and had to be out. Therefore, the family agreed to pay the driver on delivery. Once the couple agreed to the new price, there was little they could do about claiming overcharge in court. But upon delivery, they discovered that an old antique desk had been smashed to pieces, the front yard was torn up by the movers. In short there was damage and loss.
The couple approached every branch of the legal profession they could think of, for help. They finally got a call from an FBI agent, who informed then the FBI was watching the company but couldn’t get involved in their individual problem. The agent recommended that they contact the Better Business Bureau. They contacted the BBB and learned about their binding arbitration program. After asking around, they were told they had a case, but they decided not to go the court route. In the meantime, they heard about BBB arbitration, and decided to try it. One advantage of the BBB arbitration was the volunteer lawyers supplied by the BBB. Saving money on lawyer fees can mean a big difference, when a victim is asking for a relatively small settlement. The BBB was very accommodating, and gave the couple a list of three lawyers to choose from. They were asked to rank the lawyers 1,2,3 and they were subsequently matched with the first lawyer.
The BBB arbitration program is legally designed to resolve disputes between a business and customer that could not be solved through facilitated discussion or mediation. Once the dispute has reached the arbitration level, both parties agree to be bound by the decision. The customer must also agree that regardless of the decision, he will not bring the complaint before the BBB or a court of law in the future. The arbitration can be in person or via telephone.
The first choice lawyer was approved by the BBB, and after failure to solve the problem through less invasive means, a date was set up for arbitration via telephone. The arbitration lasted 3 hours. The victim was allowed to present his entire story, after which the moving company representative made rebuttal. The victim won a great point with his complaint about the broken table. When asked how the table broke, the moving company replied that it was old, and it must have jiggled around during the move. The arbitration lawyer asked the mover how the table could have jiggled around, if, as he had stated, everything was packed tightly, so as to cut down on the cubic feet of the load, (which lessens the moving bill). The moving company was trapped, and in the end arbitration found for the victims. They were awarded 2,500 out of a 5,000 claim.
Once the final decision was handed down, the company had two choices. They could either pay the sum, or face loosing their BBB status. Under those circumstances, and after initially refusing to pay, the company sent a check to the victims.
BBB arbitration, while weaker than court action, is actually quite suited to moving company complaints. Because of a statute called the Cormack Amendment shippers seeking monetary settlement from carriers, (movers), can only apply for recompense of actual loss in small claims court. This is very similar to the BBB regulations, which do not permit arbitration for: “disputes alleging criminal violations, discrimination disputes, labor disputes/claims against individuals, demands for loss of wages, mental anguish, punitive or consequential damages, personal injuries, or claims which go beyond the cost of the product or service involved; nor to disputes which have been adjudicated by a court of law, are currently in litigation, or which may not be arbitrated under the law.

Bringing Suits Against Moving Brokers
This is the first in a series of articles describing people who have successfully sued their moving carrier in small claims court.
The following story was recounted on the pages of a prominent anti-moving scam web site. The woman reporting the story, was scammed by a moving broker. For those who don’t know the difference, a moving broker, as opposed to a mover, merely arranges the move and then sells the rights for the move to a mover for a percentage of the fee. Sometimes, the mover, for whatever reason, never makes the move. Maybe he went bankrupt; maybe he pocketed his share of the move and disappeared. Then the broker is obligated to refund the deposit, he has already received from the customer. In this story, the victim made the deposit, and the movers never showed up to move her belongings. The victim then had to hire a second moving company to make the move, and she now wanted her deposit back from the first company.
Moving brokers refuse to send back the deposit for a failed move all too often in today’s world.
This woman decided to put her foot down. However, by the time she decided to go to court, she had already made the move from Florida to Dallas. Therefore, she sued the company in a Dallas small claims court. She argued before the Judge that because she had had to pay twice for her move, she didn’t have enough money to travel to Florida to sue the moving brokers, in their venue. The Judge assented. and kept the case in Dallas. The brokers argued that they were protected by the Carmack Amendment which limits the rights of consumers to sue movers for problems arising in interstate moves. The victim, or her attorney, cleverly argued that the interstate move arranged through the broker, never took place, so the claim against the broker, had nothing to do with an interstate move. Again the Judge assented, and ordered the moving brokers to pay the full refund to the plaintiff. The broker agreed to make the payment, and payment was received.

Something else that we will cover is the growth of popularity of tattooing and how this has changed over time. People that have never worked for a home assembly business before typically think that it’s as easy as signing on with the company, putting together relatively easy to assemble projects, and sending them back whenever they feel like it to get paid. I would have to say that is the more glamorized vision of how things are done. Let’s now take a more realistic look into the world of work at home assembly jobs.
How to get started. It’s as easy as signing up with a company, one might think. Not so fast. Any legitimate home assembly business knows that home assembly is not for everyone. Before they’ll even consider putting you on their pay list you are required to complete a test kit to see if you’re even capable of assembling their products. In all of the work at home assembly jobs I have tried, this already finished product has been a life saver for helping with your assembly of their product. Once you have finished how ever many units that the company requires in the test kit, you then must send it back to the company for inspection. The shipping and handling is non-refundable most of the time.
Once your test kit gets approved, it’s time for step two, buying the materials to make your first complete shipment of product. Purchasing?! you’re probably thinking. Yes, you must pay for the items needed to make your product. The people who own these companies operate a business and can’t afford to give you materials for free, even though you’ll be paid for them later. I have yet to run across a home assembly job that doesn’t make you pay for the materials in advance. But don’t think that makes home assembly jobs an instant rip off. You will always be reimbursed for the materials once you have completed your set number of projects. And if for some reason you decide you no longer want to do home assembly, most will usually refund you the money for unassembled materials.
Once you have completed your projects you must send them back in to the company for inspection before being paid. Some companies reimburse you for shipping and handling, some don’t. Inspection again, you might be thinking. Why do they need to inspect my work again if they approved my test kit? Once more, this is a business you’re dealing with. They will be selling your assembled products to consumers, some of which have no idea that the company outsources its product assembly. Any good business has quality standards. Having said that, items that are approved by the company you will be paid for. Items that the company does not approve are usually shipped back to you with a quality assurance form telling you why the company feels your work was substandard. If you want to be paid for these items, you will have to fix what is wrong with them and send them back to the company.
If you haven’t noticed, there is a decent time lapse between when you start one of these programs and when you get paid. I would highly suggest not quitting your day job until you’ve received your first paycheck and have a system in place as to when you’ll get paid for your home assembly work. Payment dates depend on the company. Some home assembly companies pay out every Friday, some once a month, some twice a month, and some within a few days of approving your completed project.
And that’s basically how it works. Rinse and repeat the steps to keep your home assembly job going, minus having to buy a test kit before every shipment of materials you order. Home assembly jobs are not for everyone. If you want to make a living off of it then you must treat it like a regular job. You must hone your skills at crafting your products and find a speedy way to produce them while still keeping with the quality standards.

Recently, a new client came in to the office for a nyc uncontested divorce. He told me that he already had documents with him prepared by LegalZoom but he had not figured out how to complete the divorce himself and wanted a lawyer to do it for him. I was interested to see the documents as I had read about LegalZoom in my research for a past article. LegalZoom is an online service where you enter all of your information pay online, and the service will provide you with a set of forms and a set of instructions on how to complete and file them.
LegalZoom has been in the news in the context of various lawsuits claiming that individuals and companies are engaged in the unauthorized practice of law by assisting people with routine legal matters such as uncontested divorces, simple wills, etc. practically all states have laws which outlaw the unauthorized practice of law by non-lawyers. In New York unauthorized practice of law is a misdemeanor. In one of the articles that I read LegalZoom argued that because they only provide people with forms (which are publicly available) and give no legal advice, that they were not practicing law., since simply furnishing such forms did not involve providing legal advice. However the prosecuting agency or agencies are claiming that that if the service decides which forms to supply this selection practice constitutes the use of legal expertise and judgment and not allowed.
This article and its author take no position on the issue of whether or not furnishing forms and instructions by a paralegal or non-lawyer is proper or improper for a simple uncontested divorce. However I had long been intrigued by the very broad disparity in what different people charge to do a simple uncontested divorce. I know that there are a number of attorneys who charge up to $2500, not including fees, while there are advertisements (usually by non-lawyers) for uncontested divorce for $199. So, I was pleased when the client let me scrutinize all of the forms that he had been provided by the company. These forms and instructions totaled a fairly large stack and included many forms which are not required for a simple uncontested divorce with no kids, property, where the defendant is willing to sign the papers . Apparently LegalZoom has responded to criticism by furnishing patrons with copies of every conceivable form which could possibly be required or even helpful. When I looked these over I tried to visualize how a non-lawyer would have to figure out which forms are really needed and how to fill them all out. There was, however, a set of telephone contact numbers which could provide support although at an extra charge in some circumstances.
I am skeptical about the value of such do it yourself services. When I first started handling uncontested divorces I had already been a lawyer for lots of years and furthermore I had the assistance of special software which I purchased for $300 and makes the process much easier, and still I had a lot of trouble on the first few divorces I prepared, and they took me a lot of time.

Emotional Intelligence Skill-building: Ultimate Strategy To Improve Performance
Enhancing the Emotional Intelligence (EI) skills of the organization’s workforce can simultaneously address many performance challenges. From a traditional business perspective emotional factors are overlooked when identifying initiatives to improve performance. However, the dimensional performance model I developed over time and describe in this article discloses how emotions play a more significant role in people’s performance than traditional factors.
For years I have worked with a model depicting the factors that affect people’s performance. A colleague once described my model as “probably the best tool ever for explaining why people do or don’t perform as desired.” The model he so generously praised was my original model that, over time I learned was flawed. It failed to depict emotions as the most critical factor affecting people’s performance.
As a result of experience, I have improved my model by adding a new dimension that includes emotions as a factor that affects all areas of performance. This new, dimensional model presents a more accurate view of the significant importance of emotions.
The original model was a one-dimensional nine-box grid (3 boxes by 3 boxes), reflecting my Engineering background. Each box identified a set of factors affecting performance with the level identifying those who typically have the most control – executives, managers, and individual performers. Overall the model identified some 30 factors affecting performance. However, it failed to recognize the critical impact emotions have on people’s performance.
According to more resent research emotions may be more important than other factors in performance. In fact, when we receive a sensory input, we process it through our emotional center first. And, before we send it on to be processed in our rational mind, the neocortex, we attach an emotional meaning to the input. (Goleman, Emotional Intelligence, 1995) Serving as a gatekeeper, our emotional center influences how we perceive and ultimately respond to the input. The information we have (or don’t have) to do our work, every assignment we are given (and how it is given), our workload, our physical environment (noise, lighting, temperature), and so on etc. has an emotional meaning attached to it.
After discovering the dramatic affect of emotions on people’s performance, I revised my original model, incorporating a third dimension – the dimension of Emotion. With the addition of depth, the new, dimensional model revealed that while the “Head” factors affected performance, emotion had a pervasive effect, positively or negatively affecting all other factors and ultimately our productivity, mental clarity, energy and more. As an example, consider how the initial announcement of a downsizing might affect people’s feelings. Their negative feelings might result in a decline in morale, quality and productivity. On the other hand consider how you feel when someone genuinely praises you on your work. In most cases, people would feel positively and would be more likely to put forth extra effort, going beyond what is expected.
Let’s examine the Emotional dimension of the revised model in more detail. Emotion can be viewed as a continuum with Fear on one end and Appreciation on the other.. Negative emotions such as anger, fear and frustration can impede performance. On the other hand when people feel appreciated and cared for, the resulting positive emotions can facilitate performance. This is what people really want. They want to feel that people care about their work and about them; they want to know that they are appreciated for their contributions. People can’t check their emotions at the door when the come to work and then pick them up on the way home. Our emotions – our hearts – are with us at all times.
It’s disconcerting when one considers that we’ve spent so much time and effort focusing on the factors in my rational, two-dimensional, “Head” model. Indeed, these factors are important. However, we’ve been missing a huge piece of the solution to improving people’s performance when we disregard emotions. The dramatic results achieved by developing people’s EI abilities presents a compelling argument to the accuracy of the “Head/Heart” model as a more powerful tool when determining interventions to improve performance.

Americans, who are severely overcharged by their moving company, are frequently disappointed to learn that because of an old American piece of legislation called the Carmack Amendment, which dates back to the early 20th century, they are in almost all cases limited to minor action in claims court. Back in 1908, when the Carmack Amendment was passed, the interstate commercial transport system was dominated by a small group of rail barons. Shippers taking carriers to court were only allowed to seek a monetary award equal to the amount they had been overcharged.
While originally targeted to rail traffic, the Carmack Amendment was later applied to interstate truck commerce,as well, and thus the modern moving industry inherited this protective immunity. Today, due a series of legal decisions in Federal court, this interpretation of the Carmack Amendment has been upheld numerous times. The result being that a moving company can charge 2-3 times more than the original moving cost estimate. They can hold a victim’s belongings hostage while demanding full payment. And the mover knows that the only possible recrimination he will probably face is an occasional civil suit. Victims taking a mover to court are faced with expensive legal bills, which eat into the small amount of compensation they can hope to win.
Given these set of circumstances, many smart movers are looking for other alternatives to transport their goods.
